The information provided will only be used in the event that Entrant is selected as a finalist or winner or if the Entrant elected to receive additional information and promotional material.

  1. ELIGIBILITY: The Essie Spring Collection Giveaway (the "Giveaway") is open to legal residents of the Forty-Eight (48) Contiguous United States and the District of Columbia (excluding Alaska, Hawaii, Puerto Rico, the U.S. Virgin Islands and all other U.S. territories and possessions) who are 18 years of age or older at the time of entry. Employees, officers and directors of Essie, Consumer Products Division of L'Oreal USA, Inc. ("Sponsor"), Buddy Media, Inc., Realtime Media LLC ("Administrator"), and each of their respective parents, affiliates, subsidiaries, divisions, advertising, promotional, fulfillment and marketing agencies (collectively, the "Giveaway Entities"), their immediate families (parent, child, sibling & spouse) and persons living in the same households as such individuals (whether related or not) are not eligible to participate in the Giveaway. Void in Alaska, Hawaii, Puerto Rico, the U.S. Virgin Islands and all other U.S. territories and possessions and where prohibited or restricted by law, rule or regulation. All applicable federal, state and local laws and regulations apply.

  2. GIVEAWAY PERIOD: The Giveaway begins at 09:00:00 AM Eastern Standard Time ("EST") on February 13, 2012 and ends at 05:00:00 PM EST on February 29, 2012 ("Giveaway Period").

  3. TO ENTER: Visit http://www.facebook.com/essie during the Giveaway Period and click on the "Exclusively Essie" tab. If you have not already done so, "Like" the page to gain access to the giveaway registration page. You will then be asked to complete the official Giveaway entry form with your true and correct information (including full name, address, email address, date of birth, and phone number including area code), and click the "Submit" button to receive one (1) entry (each, an "Entry"). LIMIT: One (1) entry per person using only one email address for the length of the Giveaway Period. None of the Giveaway Entities shall be responsible for, or will honor, lost, late, misdirected, incomplete, delayed, garbled or undelivered entries. All entries become the property of Sponsor and will not be acknowledged or returned. Please also see the "Privacy Policy" section in Section 10 of these Official Rules. By entering, entrants agree to these Official Rules and the decisions of Sponsor, which are final and binding in all respects. Any attempt by a person to use multiple email accounts to enter more than once may result in disqualification at the discretion of the judges or Sponsor.
    Entry in the Giveaway does not constitute entry into any other Giveaway, sweepstakes, contest or promotion.
  4. RANDOM DRAWING/WINNER SELECTION: An electronic randomized drawing will be held on or about March 1, 2012 by Administrator, an independent judging organization, to select five hundred (500) potential winners from all eligible Entries received. Odds of winning a prize depend on the number of eligible Entries received throughout the Giveaway Period.

  5. PRIZES: Five hundred (500) Winners will receive one (1) bottle of Essie "Navigate Her" Nail Polish. The Approximate Retail Value ("ARV") of each prize is $8.00.

    The ARV of all prizes is $4,000

    No prize substitution, cash equivalent of prize, transfer or assignment of prize (or portion thereof) permitted, except by Sponsor in its sole discretion, or as otherwise provided herein. Sponsor reserves the right to substitute the prize with one of comparable or greater value, at its sole discretion. Any difference between the ARV and actual value of the prize will not be awarded. Prizes are awarded "as is" with no warranty or guarantee, either express or implied by Sponsor. All prize details are at Sponsor's sole discretion.

    Winners will be notified by e-mail. If a prize or prize notification is returned as undeliverable, Sponsor is unable to contact a potential winner or a potential winner is not in compliance with these Official Rules, prize will be forfeited and, at Sponsor's discretion, an alternate winner selected. If a potential winner is at least 18 but still considered a minor in his/her jurisdiction of residence, prize may be awarded in the name of his/her parent or legal guardian who will be responsible for fulfilling all requirements imposed on winner set forth herein. Prizes will be sent within six (6) weeks after the conclusion of the Giveaway. If a potential winner fails to fully comply with these Official Rules, he/she will forfeit that prize and the prize may be awarded to an alternate potential winner as selected by the Sponsor and the Giveaway Entities. Limit one (1) winner per household.

    All decisions of the Sponsor shall be binding and final. The Sponsor and the Giveaway Entities do not assume any responsibility for any disruption in the Giveaway caused by circumstance or other unforeseen events. In the event there is a discrepancy or inconsistency between disclosures and other statements contained in any Giveaway materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern, and control. In no event will more than five hundred (500) Prizes, as listed above, be awarded.

    A prize not accepted by a Prize Winner will be forfeited. Sponsor and Giveaway Entities have neither made nor are responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, condition, or fitness for a particular purpose.

  6. GENERAL CONDITIONS: Entrants grant the Giveaway Entities the right to use and publish their proper name, image, likeness and state of residence online in connection with the Giveaway. Acceptance of a prize constitutes permission for the Giveaway Entities and their affiliates to use winner's name, image and likeness, or take photographs or video, solely for advertising and promotional purposes as the Giveaway Entities so determine without notice or further compensation, except where prohibited by law. All decisions of the Administrator shall be binding and final. Entries will be deemed made by the authorized account holder of the email address submitted at time of Entry. In the event of a dispute regarding the identity of any potential winner, the potential winner will be deemed to be the authorized account holder of the email address submitted at time of Entry. The authorized account holder is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses or the domain associated with the submitted email address. A potential winner may be requested to provide the Sponsor with proof that the potential winner is the authorized account holder of the email address associated with the winning Entry. If, in Sponsor's sole determination, a dispute cannot be resolved, the Entry will be deemed ineligible. Entries generated by a script, macro or other automated means will be disqualified. Entries that are incomplete garbled or corrupted are void and will not be accepted.

  7. DISQUALIFICATION: Entrants found tampering with or abusing any aspect of this Giveaway, as solely determined by Sponsor and the Giveaway Entities, will be disqualified. If disqualified for any of the above abuses, Sponsor reserves the right to terminate entrant's eligibility to participate in the Giveaway. Any attempt by any person to deliberately undermine the legitimate operation of the Giveaway may be in violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

  8. LIABILITY & RELEASE: By participating in the Giveaway, entrants agree to release and hold harmless the Sponsor and the Giveaway Entities, and the respective officers, directors and employees of each, from and against any claim or cause of action arising out of participation in the Giveaway or receipt or use of a prize, including, but not limited to: (a) unauthorized human intervention in the Giveaway; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, delayed, undelivered, misdirected, or garbled entries; (e) errors in the administration of the Giveaway or the processing of Entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Giveaway or receipt of the prize. Entrant further agrees that in any cause of action, the Sponsor's and the Giveaway Entities' liability will be limited to the cost of entering and participating in the Giveaway, and in no event shall the Sponsor or the Giveaway Entities be liable for attorney's fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. Sponsor and the Giveaway Entities reserve the right to correct typographic, clerical or printing errors in any Giveaway materials. Sponsor and the Giveaway Entities are not responsible for any typographical or other error in the printing of this Giveaway, the administration of the Giveaway or in the announcement of prize winners, including such error as may give an erroneous indication that a prize has been won. In the event the Sponsor or the Giveaway Entities are prevented from continuing with this Giveaway, or the integrity and/or feasibility of the Giveaway is undermined by any event including but not limited to any fraud, virus, technical problem, fire, flood, epidemic, earthquake, explosion, labor dispute, or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state, or local government law, order of regulation, order of any court or jurisdiction, or other cause (each a "Force Majeure" event) or any other technical problem that corrupts the administration, security, or proper play of the Giveaway, as determined by Sponsor in its sole discretion, the Sponsor and the Giveaway Entities shall have the right, in their sole discretion, to abbreviate, modify, suspend, cancel or terminate the Giveaway without notice or further obligation. If the Sponsor or the Giveaway Entities, in their discretion, elect to abbreviate, cancel or terminate the Giveaway as a result of a Force Majeure event, the Sponsor and the Giveaway Entities reserve the right, but shall have no obligation, to award the prizes in a random drawing from among all valid and eligible Entries received up to the time of such Force Majeure event.

  9. TAX INFORMATION: All applicable federal, state, local, and other taxes on prizes are the sole responsibility of the applicable winners.

  10. PRIVACY: Except as noted in these Official Rules, information collected from each entrant is used only for the purpose of the prize drawing, to notify potential winners, and will not be re-used, sold or shared in any manner by Sponsor or the Giveaway Entities, or any third parties, unless entrant has elected to receive additional information and promotional material from Sponsor or a third party. Once the Giveaway has ended, all information supplied by entrants will be removed from the promotion database. In the event of any discrepancy between the Sponsor's Privacy Policy and these Official Rules, these Official Rules shall control and govern. By entering the Giveaway, you agree to all of the terms and conditions of the Sponsor's Privacy Policy, which is available at: http://www.essie.com/privacy-policy/.

  11. DISPUTES: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of New York. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsors in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.

  12. SEVERABILITY: If any provision of these Official Rules is found to be invalid or unenforceable by a court of competent jurisdiction, such determination shall in no way affect the validity or enforceability of any other provision herein.
